Ryanair refused to pay flight compensation due to strike

Under the European Union Regulation EC261, air passengers have the right to be entitled up to 600 euro delayed or cancelled flight compensation due to airline strike. Ryanair had several staff strikes last year, now this low-cost carrier avoids paying compensation for the passengers for flight delay or cancellation. 

Ryanair refused to pay compensation to Dutch passengers, who were affected by flight delays and cancellations last summer due to Ryanair strike. Flight claim company Aviclaim, representing Ryanair passengers, won at a canton court. Ryanair was sentenced to pay out compensation to the victims of these delays and cancellations.

However, Ryanair took the lawsuit to the Supreme Court – Ryanair states that the canton court judge has not taken the right decision. It is possible that Ryanair will lose the highest court also as the European Court has already ruled in the past that a strike by the airline staff does not fall under extraordinary circumstances.

What are the dates of Ryanair strikes in 2019?

This summer there will be more Ryanair staff walkouts. There is planned a British pilot strike in the United Kindom on 22 – 23 August and 2 – 4 September. Ryanair pilots in Ireland also go on strike on 22 – 23 August. Ryanair cabin crew decided to walk out in Spain on separate days in September: 1, 2, 6, 8, 13, 15, 20, 22, 27 and 28.

Update: the strike in Ireland was cancelled due to the court decision.

What are air passenger rights when the flight is delayed or cancelled due to strike?

  • The flight was delayed, cancelled by the airline staff (employees that work directly for the airline) strike.
  • You arrived at the final destination 3 hours later than it was planned, or the flight was cancelled and you were informed about it less than 14 days before departure.
  • Flight departure was planned from the EU or to the EU (but only with EU based airline).
  • The flight reservation was confirmed.
  • Flight delay or cancellation occurred within the last 3 years.
