Flybmi – how to get compensation for the cancelled flight?

Flybmi, airline company from UK, has cancelled all its flights and has filed for administration. Passengers are left in chaos and uncertainty what to do – how to get the money paid for the tickets back.

Flybmi blamed its failure on uncertainty about Brexit, rising fuel and carbon costs, and falling passenger numbers. There were more airline collapse in 2018 and 2017. It is predicted that only the strongest will survive, such as British Airways, Lufthansa, Ryanair, Easyjet etc., thus this is not the last airlines failure. There was already Air Berlin, Monarch, Cobalt Air, Primera Air, Small Planet Airlines and other airlines collapses in previous four years.

The Civil Aviation Authority (CAA) advised passengers to check if their travel agencies or other sellers, such as Flybmi’s codeshare partner airlines (including Lufthansa, Brussels Airlines, Turkish Airlines, Loganair, Air France and Air Dolomiti), from whom they bought Flybmi flight tickets have ATOL (Air Travel Organiser’s Licence) certificate as they would be eligible for replacement flights or a compensation if so. However, air travellers who bought their tickets direct from Flybmi are not protected by ATOL, so in these cases they will have to organise their refund on their own. Those whose flight tickets are protected by ATOL, need to contact their seller.

Furthermore, passengers who bought their tickets by credit card, may have the possibility to get their money back under Section 75 of the Consumer Credit Act, which states that card providers are jointly liable when a purchase or service isn’t fulfilled. If passengers paid for flights by debit card, they might receive a refund via a scheme called Chargeback. However, unlike Section 75, Chargeback isn’t a legal requirement so there is no guarantee passenger will get the money back.

What is more, passengers who has travel insurance might get a refund for cancelled Flybmi flights if they were covered for “scheduled airline failure insurance” (SAFI). Those who have travel insurance should also check the chance to be refunded in this way.

Unfortunately, there is no chances to receive cancelled flight compensation under EC 261 Regulation as Flybmi airline company has no cash and there is a long line of creditors owed money.
